These Terms of Service (“Terms”) govern your use of the Gorden Web Design website and services. By using our Site or engaging our services, you agree to these Terms.

Gorden Web Design provides custom web design, development, and related digital services (“Services”) to small businesses and individuals (“Client” or “you”).
2. Project Agreements
All web design projects require a written agreement or proposal that includes:
- **Scope of work** — Specific deliverables and features
- **Timeline** — Project milestones and completion date
- **Pricing** — Fixed-price quote or hourly rate
- **Payment terms** — Deposit, milestones, final payment
- **Revisions** — Number of included design revisions
- **Ownership** — Intellectual property rights upon final payment
The project agreement supersedes these Terms in case of conflicts.
3. Payment Terms
- **Deposits:** Typically 50% upfront, 50% upon completion (varies by project)
- **Payment methods:** Credit card, ACH transfer, check
- **Late payments:** Interest of 1.5% per month on overdue balances
- **Payment processing:** Stripe, PayPal, or invoicing via GoHighLevel
- **Refunds:** See Section 4
4. Refund Policy
**Before project starts:** Full refund of deposit minus any non-refundable expenses (e.g., domain registration, stock photos, premium plugins).
After project starts:
- **Within 7 days:** 50% refund of remaining balance
- **After 7 days:** No refund, but you retain all work completed to date
- **Project abandonment by Client:** No refund, work completed to date becomes Client property upon final payment
**Disputes:** Contact us first at billing@gordenwebdesign.com. We aim to resolve disputes amicably.
5. Client Responsibilities
You agree to:
- Provide content (text, images, logos) in a timely manner
- Review mockups and provide feedback within agreed timeframes
- Make payments according to the agreed schedule
- Provide accurate information for domain registration and hosting setup
- Obtain necessary licenses for any content you provide
6. Intellectual Property
Upon final payment:
- You own all rights to the final website design, content, and custom code created specifically for your project
- We retain rights to:
- Reusable code libraries, frameworks, and tools
- Design templates and components
- Portfolio rights (we may display your project in our portfolio unless you request otherwise in writing)
Before final payment:
- All work remains our property
- You have no right to use the work in production
Third-party assets:
- Stock photos, premium plugins, and third-party services retain their original licenses
- You’re responsible for ongoing license fees (e.g., premium plugin subscriptions)
7. Hosting and Domain
Hosting:
- We recommend Hostinger (we earn a small referral commission)
- Hosting fees are separate from design fees
- You may use any hosting provider; we’re happy to work with your choice
- We’re not responsible for hosting outages, security breaches, or data loss on third-party hosting
Domains:
- Domain registration is your responsibility
- We can register and manage domains on your behalf with your authorization
- Domains are non-refundable once registered
8. Ongoing Maintenance and Support
Included support (30 days post-launch):
- Bug fixes related to our code
- Minor content updates (up to 1 hour)
- Email support
After 30 days:
- Optional monthly maintenance plans available ($49-$199/month depending on needs)
- Hourly support: $75/hour
- Emergency support: $150/hour (response within 4 hours)
9. Warranties and Disclaimers
We warrant that:
- Services will be performed in a professional and workmanlike manner
- Final website will be free of defects in our custom code for 30 days
- We’ll fix any defects in our work at no charge during the warranty period
We do NOT warrant:
- Third-party plugins, themes, or services
- Hosting uptime or security
- Search engine rankings (SEO is best-effort, not guaranteed)
- Compatibility with future browser updates or platform changes
- Outcomes from your content or marketing efforts
THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
10. Limitation of Liability
**Maximum liability:** The total amount you’ve paid us for the specific project in question.
We are NOT liable for:
- Lost profits or revenue
- Business interruption
- Data loss (you’re responsible for backups)
- Third-party claims
- Indirect, incidental, or consequential damages
11. Indemnification
You agree to indemnify and hold us harmless from any claims arising from:
- Content you provide (copyright infringement, defamation, etc.)
- Your use of the website after launch
- Violations of these Terms
12. Termination
By you:
- You may terminate the project at any time with written notice
- You’re responsible for payment of work completed to date
- See Section 4 for refund terms
By us:
- We may terminate for non-payment, abuse, or violation of these Terms
- You’ll receive all work completed to date upon final payment
13. Confidentiality
We treat your business information as confidential and won’t disclose it to third parties without your consent, except:
- As required by law
- To service providers working on your project (with confidentiality agreements)
- With your written permission
14. Governing Law
These Terms are governed by the laws of the State of Washington, USA. Any disputes will be resolved in the courts of Grant County, Washington.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email (if you’re a client) or by posting a notice on our Site.
